Sheikh Hamdan forms interim steering committee to oversee transfer of commercial control operations in Dubai

In his capacity as Chairman of the Executive Council of Dubai, H.H. Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, the Crown Prince of Dubai, Deputy Prime Minister, and Minister of Defence, has announced Executive Council Resolution No. (99) of 2024. This resolution establishes the Steering Committee tasked with overseeing the transfer of commercial control operations within the emirate of Dubai.

The resolution outlines the creation of a temporary committee named the “Steering Committee for Overseeing the Transfer of Commercial Control Operations in the Emirate of Dubai,” which will be led by the Secretary-General of the Supreme Legislation Committee.

Membership composition

The committee’s membership will include representatives from various sectors: the Department of Finance, the Dubai Government Human Resources Department, the CEO of the Dubai Corporation for Consumer Protection and Fair Trade, the CEO of the Regulatory Policies and Governance Sector, the CEO of the Legislation and Disputes Sector at the Department of Economy and Tourism in Dubai, and a representative from the government entity authorized by current legislation to conduct commercial control activities in Dubai.

Powers and responsibilities

As per the resolution, the Steering Committee will be entrusted with several powers and responsibilities, including:

  • Approving the timeline and phases for transferring commercial control functions and operations from regulatory bodies to the Dubai Corporation for Consumer Protection and Fair Trade.
  • Streamlining and organizing commercial control operations within local markets by identifying and categorizing all types and forms of commercial control executed by regulatory bodies and the Authority.
  • Reviewing procedures related to commercial inspections and controls, suggesting amendments, standardizations, and simplifications, and presenting these recommendations to the Executive Council of Dubai.

Coordination and collaboration

Additionally, the Steering Committee will be responsible for:

  • Establishing protocols and mechanisms for coordination between regulatory entities and the Dubai Corporation for Consumer Protection and Fair Trade regarding the execution of inspection processes within their respective domains, including managing the exchange of information and data among these entities.
  • Consulting with relevant experts as deemed appropriate to assist in fulfilling its responsibilities.
  • Ensuring the integration of roles, coordination of efforts, exchange of information, and collaboration between government and regulatory bodies on all matters that facilitate the Steering Committee’s ability to perform its assigned tasks as outlined in this resolution.

Handling disputes and monitoring implementation

The Steering Committee will also handle:

  • Making necessary determinations regarding any issues or disputes that arise between the Authority and regulatory bodies, particularly if amicable resolutions cannot be achieved, and referring such matters to the Executive Council of Dubai when required.
  • Monitoring the implementation of the plan to transfer commercial control tasks and operations, tracking progress, and issuing necessary directives to address any obstacles or challenges encountered throughout the various stages.

Mandate for cooperation

The resolution mandates that all government entities in the emirate, including regulatory bodies and supervisory authorities in special development zones and free zones, such as the Dubai International Financial Centre, must fully cooperate with the Steering Committee, its subcommittees, and working groups. Moreover, they are required to provide any requested data, information, statistics, documents, and studies deemed necessary by the Steering Committee within the specified timeframe.

Additionally, the Chairman of the Steering Committee for Overseeing the Transfer of Commercial Control Operations in the Emirate of Dubai will issue the necessary decisions, instructions, and directives to implement the provisions of this resolution.

This resolution will take effect upon its publication in the Official Gazette.
