In his role as the Ruler of Dubai, Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, has issued Decree No. (49) of 2024. This decree regulates the appointment of employees from the Dubai Government to serve as members of Dubai’s judicial authorities.
The Decree, Dubai Media Office reported, seeks to attract national talent for positions within Dubai’s judicial system, while ensuring that employees retain their legal status, rights, and financial benefits during their training at the Dubai Judicial Institute.
The training includes the Judicial and Legal Studies Program for judges and the Diploma in Legal and Judicial Sciences for Public Prosecutors. Importantly, the Decree allows employees to keep their roles within their respective government entities throughout their training.
Scope of applicability
This Decree is applicable to qualified civilian and military personnel employed in government entities that adhere to human resources regulations, including Law No. (6) of 2012, which pertains to local military personnel, and Law No. (8) of 2018, which addresses human resources management for the Dubai Government.
However, Directors General governed by Law No. (8) of 2013, as well as CEOs under Law No. (8) of 2021, are exempt from its provisions.
The Decree specifies the rights of employees during their training, including the provision of their full monthly salary, in accordance with the human resources regulations of their respective entities, though allowances or additional benefits are excluded.
It also stipulates the conditions for granting training leave to participants in the program, emphasizing that they must be UAE nationals who meet the admission criteria outlined in Law No. (13) of 2016 regarding judicial authorities in the Emirate of Dubai, along with its amendments and related decisions.
Moreover, the Decree mandates that employees participating in the training program adhere to all regulations and guidelines established by the Dubai Judicial Institute.

Post-training obligations
Upon successful completion of the program and subsequent appointment by the Judicial Council, they are obligated to serve in one of the judicial authorities for a minimum of five years, unless this requirement is waived or modified by the Council.
According to the Decree, failure to fulfill this commitment will necessitate the repayment of all salaries received during the training period. Additionally, it outlines further obligations set by the Judicial Council and the circumstances under which salary repayment will be enforced.
Furthermore, the Decree clarifies that if an employee does not complete or meet the training program’s requirements, they will retain their position within their government entity prior to their enrolment.
This Decree will take effect from the date it is published in the Official Gazette.
