The European Union (EU) is set to levy a substantial fine of about $539 million (€500 million) against Apple Inc. over alleged violations of EU competition laws early next month. It follows accusations that Apple’s App Store rules distort competition in the music streaming market.

Anticompetitive behavior

A complaint filed by Spotify in 2019 prompted the EU’s investigation into Apple’s practices. Spotify alleged that Apple’s imposition of a 30 percent commission on app developers stifles choice and innovation. Therefore, the impending fine marks the EU’s first action against Apple in response to antitrust concerns.

Last year, the European Commission accused Apple of unfairly influencing competition in the music streaming sector by imposing rules on the App Store that restrict developers from informing users about alternative purchasing options. Hence, Apple’s actions to stop rival music streaming services from telling users about cheaper options outside its App Store breached EU competition rules. These rules, according to the EU, hinder competition and innovation within the digital marketplace.

Response and changes

Apple has yet to comment on the reports of the impending fine. However, the tech giant has recently made adjustments to its App Store policies in an effort to comply with EU regulations, particularly the Digital Markets Act. These changes include reducing the commission rate from 30 percent to 17 percent, along with additional fees for payment processing.

Despite Apple’s adjustments, critics argue that the new fee structure could still impose significant financial burdens on app developers.
